“A miracle he was not killed” says judge after fining logistics company 75,000

PK & IF Cobley Limited were fined £75,000 as employee Andrew Bannister, of 15 years, sustained life changing injuries after he was instructed to repair cracks in a fragile roof at Misterton Farm in Leicestershire without any means of preventing him from falling.

Mr Bannister fell approximately 10 metres through the roof and landed on concrete flooring, sustaining injuries which included a broken back, and three broken ribs.

The logistics firm were later found guilty for breaching the Work at Height Regulations 2005 at Leicester Crown Court and were fined £75,000 as well as being ordered to pay £29,351.88 in costs.

The judge hearing the case held it to be a miracle that Mr bannister was not killed as the job he was instructed to do was obviously very dangerous.

In response to the sentence imposed; Alison Cook, who was the investigator and prosecutor on this case, said: “The risk of falls through fragile roofs is well-known and the precautions required are simple and effective. This sentence will serve as a warning to firms that knowingly risking employees’ lives in the course of their work will not be tolerated.”

Hand and arm injury leads to fine

Totternhoe Metal Recycling Limited (TMR) have been fined £12,000 and ordered to pay costs of £1,889.60 after pleading guilty to breaching the Health and Safety at Work etc. Act 1974. They were also ordered to pay a £120 victim surcharge.

The Health and Safety Executive (HSE) prosecuted TMR after a 40 year old employee suffered damage to his hand and arm whilst delivering waste metal to the company's recycling centre. A wheeled crane was used to unload the metal from the van but whilst the van was parked, the crane's counterbalance hit the van's rear door and caught the employee's left hand.

As a result, the worker lost the top of his thumb and also damaged his arm. He required skin grafts to his thumb and surgery to repair the damage to his arm. Unfortunately, the worker is unable to use his thumb or grip anything with his left hand, even though the injury was sustained 15 months ago.

HSE inspector Emma Page said: “The accident rate within the waste and recycling industry remains one of the highest in any industry. As in this case many of these incidents relate to contact between vehicles and pedestrians.

“Totternhoe failed to put in place control measures to ensure adequate segregation of vehicles and pedestrians despite having identified and acted upon this issue at another site belonging to their sister company. Had they done so, the injuries to this worker, which have left him affected both physically and emotionally, could have been avoided.”

She added: “Where duty holders fall short of industry standards, HSE will not hesitate to take enforcement action against those who create the risk.”

Regulation (EU) 1107/2015 (OJ:L181/72/2015) approving the basic substance Salix spp. cortex, in accordance with Regulation (EC) 1107/2009, on the placing of plant protection products on the market, and amending Implementing Regulation (EU) 540/2011

This Regulation approves the basic substance Salix spp. cortex for use in plant protection products.
As a result, Regulation (EC) 540/2011, implementing Regulation (EC) 1107/2009 on the list of approved active substances, is amended, adding this substance to the Annex of that Regulation, which details approved substances.
