Ship Recycling Facilities Regulations (Northern Ireland) SR 2015/229

These Regulations came into force on 18 May 2015 and apply to Northern Ireland only.
They implement Regulation (EU) 1257/2013, on ship recycling, and provide for facilities located in Northern Ireland to be authorised in accordance with that Regulation, so that they may be added to the European List.

Regulation (EU) 628/2015 (OJ:L104/2/2015) amending Annex 17 to Regulation (EC) 1907/2006 on the Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH) as regards lead and its compounds

This Regulation amends Annex 17 to Regulation (EC) 1907/2006 on the Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH) regarding lead and its compounds.

Non-licensed asbestos work provisions in force

As of 1 May 2015, new medical surveillance requirements for workers carrying out notifiable non-licensed asbestos work (NNLW) came into force.

The revised Control of Asbestos Regulations SI 2012/632 were introduced because the UK had not fully implemented the EU Directive 2009/148/EC on exposure to asbestos, particularly the articles exempting activities involving only sporadic and low intensity exposure to asbestos. To address this, the revised Regulations imposed extra requirements on some types of non-licensed asbestos work, including notification, medical surveillance and record keeping.

Only some types of non-licensed work are deemed notifiable NNLW, which include:

  • removal of asbestos cement products where the material will be substantially damaged or broken up;
  • short duration work to remove asbestos insulating board as part of a refurbishment; and
  • large scale removal of textured decorative coatings using steaming or gelling methods.

The notification and record keeping requirements changed in April 2012, but the duties on medical surveillance were given a three year phase-in period.

So as of 30 April 2015, all workers carrying out NNLW must have a medical examination, which should be repeated at least every three years, providing the work continues.

In addition, from 1 May, workers carrying out NNLW for the first time will have to have an examination before they can start work.

All such examinations must be carried out in work time at the employer's expense. Doctors will issue a certificate to state the examination has taken place, which employers need to keep for four years.
